Od sovjetskog nasleđa do evropske integracije: dostojanstven rad u reformama ukrajinskog radnog zakonodavstva

Apstrakt

Rad analizira reforme radnog zakonodavstva Ukrajine iz ugla njihove usklađenosti sa međunarodnim i ustavnim normama, posebno sa principima MOR-a i direktivama EU. Razmatrani teorijski pristup polazi od stava da dostojanstven rad treba da predstavlja temelj politike socijalne pravde u demokratskoj državi. Studija naglašava značaj uravnotežavanja interesa poslodavaca i zaposlenih u procesu usklađivanja ukrajinskog radnog zakonodavstva, naročito nacrta Zakona „O radu”, sa standardima EU. Takođe se analizira državno regulisanje zapošljavanja i radne migracije kako bi se jasno definisale uloge i izvori finansiranja institucija za zapošljavanje. Rad ukazuje na potrebu za ažuriranjem Zakona „O zapošljavanju stanovništva”. Posebna pažnja posvećuje se zakonodavnim inicijativama koje mogu da potkopaju pravne obaveze Ukrajine i oslabe sindikalne institucije i demokratski diskurs o radu.
